Goldstein Law Office is now a participant in the Collaborative Law Institute, an organization intended to minimize conflict while working towards resolutions in divorce and separation proceedings. Collaborative attorneys seek to arrive at mutually agreeable solutions, without having to resort to litigation.

Due to the emotional, financial and legal complexities that divorce attorneys must address, collaborative law provides the means to dissolve a marriage without the additional contention that can saturate a divorce proceeding. Parties can initiate the process by signing a Participation Agreement, which facilitates open communication, confidentiality, and grants authority to the attorneys to negotiate the terms of dissolution without contested court appearances.

At the inception of the process, both parties meet with their respective attorneys to discuss their individual concerns. After the initial consultation, a four-way session is held between both parties and their attorneys to seek settlement on property division, custody, support, and other issues. Attorneys are able to contribute their skills and advice, while focusing the settlement on what is mutually beneficial to the parties and their children.

Benefits of collaborative law include protecting children from the harmful effects of litigation, focusing on a positive solution for the entire family, ensuring that all financial matters are accurate and disclosed at reasonable cost and preserving a working relationship between spouses even after the divorce has been completed.

Parties can minimize both the financial and emotional costs of a divorce proceeding by participating in collaborative law. As litigious issues can become compounded during a normal proceeding, attorney fees can also begin to mount. It is in the best interest of both parties to work directly with each other to minimize fees. Instead of litigating, parties are maximally utilizing attorney time through collaboration. The parties can also mitigate the emotional expenses of litigation by maintaining a level of mutual respect made possible through guided negotiations.

After a settlement is reached, the attorneys file the appropriate paper work and no appearances are necessary to finalize the divorce. Attorneys who agree to the collaborate process also agree to withdraw if the collaborative process ends.
